RON HERBERT & TODD ANDERSON RETAIN DEFENSE WIN ON APPEAL
In April, the Supreme Court of Virginia unanimously upheld Ron & Todd’s defense verdict in a suit claiming negligent management of hypotension resulting in a spinal nerve root injury and partial paralysis. At trial, the court refused the plaintiff’s jury instruction seeking to hold the physician liable for “all the consequences of [his] negligence, whether foreseen or not.” The Supreme Court found this language to be a “strict liability instruction and an inaccurate statement of Virginia tort law,” thus it was properly refused.
